Infância e adolescência : punição, controle e o sistema de garantia de direitos

Abstract

This work has as its proposal to carry out a study about the controlling and punishing process, which is being implemented on the impoverished infant-juvenile segment in Brazil, more precisely the adolescents involved in acts considered as infringement. The punitive and vigilance practices of private life are presented in various historic moments such as strategy of domination and power between social classes extended to children and adolescents, under the discourse of protection, education or formation for work. In Brazil, such submission relation can be expressed through social indicators, of public programs directed to inferior and undervalued work and the high indices of violence and extermination in general, directed to a portion of the specific adolescence and infancy: the poor people, black people, coming from working class families and living in the large slums of the metropolis in the country. Considered as dangerous classes they are constantly under vigilance by the public power and the civil society, which cover such actions, basing themselves on objects of criminality prevention, maintenance of the public order as well as guarantee of private property. For the ones who deceive such rules and commit infringing acts, the punitive practices can start to be applied even before the sentence is given by the Judicial system: at the moment of arrest carried out by the police authority. Having as its object to understand how such quotidian of vigilance and punishment is materialized for such segment of the population, a field research was carried out by the Delegacia de Proteção à Criança e ao Adolescente (Office for Children and Adolescents Protection) DPCA in the municipality of Niterói, which is specialized on attending adolescents who are authors of infringing acts. When delimiting the research field, priority was given to the first instance of repression and punishment instituted by the public power, that is the police headquarters.
