Abstract

This work searches the influency that humanitarian questions have over the modern armed conflict. Approaches the evolution of just war concepts as the former of International Rights of Armed Conflicts, and shows the evolution of philosophical thought about the limitations of wars. Presents the conceptions in the Custom Right And Positive Right to the armed conflicts, showing the juridical implications of Jus in Bello. Are shown the various dimensions involved in the rules of application of the Humanitarian Right, and specifically in the Kosovo Conflict, considering the attitude of armed forces and humanitarian institutions involved. The aim is to comprehend the performance of military power to the protection and assistance of war prisoners
