Abstract:	O presente trabalho busca aprofundar-se no estudo da lei nº 13.058 de 22 de dezembro de 2014 que introduziu a nova ótica do instituto da guarda compartilhada no direito brasileiro. Não obstante já ter sofrido alterações com a lei nº11. 698/2008 foi o diploma legal mais recente que introduziu a principal inovação, na qual adota-se como regra a modalidade de guarda compartilhada após o rompimento do casal e, portanto, perfazendo uma releitura do direito de convivência e do poder familiar.
metadata.dc.description.abstractother:	This work aims to deepen into the study of the Law 13.058, enacted in December 22, 2014, that introduced the new perspective of the Institute of joint custody in Brazilian law. Despite the changes implemented by the law 11. 698/2008 it was the latest legislation that introduced the main innovation, which is adopted as a rule the form of joint custody after the breakup of the couple and, therefore, making a reinterpretation of the right of living and family power
